How the city's code counts a pool deck

Bee Cave's Unified Development Code counts concrete, asphalt, masonry and paving-stone surfaces as impervious cover, but not the water surface of a swimming pool, and it caps impervious cover on new development at 40% of the net site area. The City's 2016 comprehensive plan describes a 20% cap for single-family homes; the plan sets policy, and the code is the rule. By our reading, a new coating over an existing slab adds no area, while widening the deck does, so an extension is the part to measure against the lot.

Setbacks, cuts and creeks

In the AG, R-1, R-2 and R-3 zoning districts, a permanent pool, spa or hot tub and comparable flatwork may sit in a required side or rear setback if it stays at least 5 feet from the rear property line; in other districts the setbacks apply. Cuts and fills are limited to four feet of depth, with exceptions that include building a pool or a foundation, and no deck, pool or other structure may be built inside an erosion hazard setback protecting a stream.

Permits and the flatwork fee

The City says a permit is needed "in most cases", and its examples include swimming pools and decks of more than 200 square feet or more than 30 inches above grade. Its fee schedule sets $50.00 for a flat work permit (driveways, sidewalks, parking lots and similar work), $500.00 plus plumbing and electrical fees for a swimming pool, and $350.00 for each reinspection after a safety and security violation. Bee Cave has adopted the 2015 International Residential Code with its appendices. Only stormwater may go into Bee Cave's stormwater drainage system. The code names filter backwash from a pool, fountain or spa, and pool water carrying more than three parts per million of chlorine or harmful amounts of muriatic acid or other pool chemicals, among the banned discharges. Read plainly, the first rule leaves out deck wash water too, so the rinse from pressure-washing or acid-etching a deck stays on the property instead of running to the street. The City's comprehensive plan describes Bee Cave's soils as generally shallow, calcareous and moderately alkaline, mostly of the Brackett and Tarrant types, on ground that rises from about 740 feet along Little Barton Creek to about 1,100 feet in the northwest, with rainfall averaging about 30 inches a year. At the city's Census center point, the federal soil survey maps Volente silty clay loam on 1 to 8 percent slopes, one point rather than the whole city.

The City says Bee Cave takes its name from colonies of Mexican honeybees that lived along the banks of Barton Creek and Little Barton Creek. Dietrich Bohls settled the area in the early 1850s, according to the Handbook of Texas, which reports the population at fifty from the 1940s through the 1980s, then 241 in 1990 and 656 in 2000. Bee Cave incorporated in 1987, run from a portable building and covering about two square miles with an 8,800-acre extraterritorial jurisdiction. It became the City of Bee Cave in 2006, and voters approved a home-rule charter in 2013.
