West Lake Hills defines a "private residential pool" as any swimming pool, wading pool or soaking hot tub that serves a home's residents and their guests, so a new spa is a pool in the City's eyes. Pools need a permit of their own, separate from any building permit for a remodel, addition or new house and with separate fees, and every application goes through the City's MGO Connect portal. On June 24, 2026 the City adopted the 2021 International Swimming Pool and Spa Code as its Swimming Pool and Spa Code.

What that code asks of a backyard spa

The code's spa chapter covers how a permanent home spa is designed, installed, built and repaired. In short: water no more than 4 feet deep, seats no more than 28 inches under the surface, makeup water no hotter than 104°F, and heater return water capped at 140°F. A spa that relies only on skimmers needs one for every 150 square feet of surface, an electric heater needs its own on-off switch within 3 feet, and a gas heater may not burn a standing pilot light.

Fitting a spa onto a hillside lot

At the city's Census center point, the federal soil survey maps Brackett soils and urban land on 12 to 30 percent slopes, one point rather than every lot. The City's amendment to the residential code requires a pool or spa to keep a 1:1 ratio between its depth and its distance from the nearest building foundation or retaining-wall footing, unless a sealed engineered design is submitted and approved.

The City's pages don't say whether a spa added to an existing pool pays the full swimming pool fee, so ask before the plans are drawn.

Filling and draining under the City's water rules
